The Accessibility for Ontarians with Disabilities Act Alliance has asked the Human Rights Tribunal of Ontario for information as the Alliance prepares its submission to the Independent Review of the Human Rights Code being conducted by Andrew Pinto. So that all individuals and organizations may have access to this information, the HRTO has posted its responses below.

On behalf of the Human Rights Tribunal of Ontario (HRTO), I am pleased to welcome you to our website.

Social Justice Tribunal Clustering

In December 2009, the Adjudicative Tribunals Accountability, Governance and Appointments Act 2009, received Royal Assent. The Act allows government to cluster tribunals and agencies with common stakeholders and related issues in order to improve public services. The regulation for the social justice tribunals cluster was passed on January 25, 2011.

Early Mediation Dates

The HRTO sometimes has dates available for mediation due to late rescheduling requests, adjournments or settlements. You can ask for an early mediation date if all parties have agreed to mediation and you are able to agree on dates within four weeks of your request.

Please make your request for an early mediation date by sending an email to the Registrar, copied to all other parties, and using the following format for the subject line:

Updated Practice Direction on Scheduling of Hearings and Mediations, Rescheduling Requests, and Requests for Adjournments

The HRTO has updated its approach to scheduling and rescheduling mediations and hearings based on experience. The changes clarify what parties must do if they are unable to attend a mediation or hearing on the date(s) scheduled and want to reschedule. Parties are strongly encouraged to agree on alternative dates, but if that is not possible, the HRTO will set the new date(s) based on the information provided.

Following a period of public consultation, the Tribunal has revised itsRules of Procedure Governing Applications under the Human Rights Code, Part IV. The HRTO’s Practice Directions, Forms and Guides have also been updated.
